Frontex Serious Incident Reports released between December 2025 and February 2026 documented masked men used in violent pushbacks at the Greek Evros border alongside Greek officers — beatings, theft, sexual violence, forced returns. Frontex was reviewing 12 cases of potential human rights violations. A case before the Court of Justice of the EU was seeking an order to halt Frontex's Greek operations entirely.
The Commission simultaneously offered Frontex deployment to Spain in response to the Ceuta crisis — the same agency under CJEU proceedings for covering up rights violations in Greece, now being positioned as the institutional instrument of European border management.
Falsifiable prediction (August 1, 2026): The Frontex investigation into Greek pushback violations will be resolved without meaningful accountability for the agency or for Greek authorities. Specific indicators: CJEU case dismissed or settled without injunction; Frontex mandate not suspended in Greece; no Greek government officials face proceedings; Frontex annual report characterises the SIR process as evidence of accountability rather than evidence of violations; the masked men in the Evros reports are never publicly identified.
The operational logic is clear: the Commission cannot simultaneously investigate Frontex for rights violations and deploy Frontex as the institutional backbone of proximity politics border management. One of those functions has to give. The investigation gives.
The charge: The EU's border agency is too operationally necessary to be held accountable.
