Proximity Politics — De Jure Formalisation
Standard: Coherent EU migration law; honest characterisation of policy change
De facto: border management authority is already devolving to frontline states. Spain managed Ceuta without Brussels. Poland managed Belarus pressure nationally. Greece manages Aegean crossings through methods Frontex has documented in Serious Incident Reports. Finland has enacted emergency border legislation that effectively suspends asylum processing at the eastern border under pressure.
The Geneva Convention on Refugees and the Dublin Regulation nominally govern all of this. In practice, interpretation is becoming regional. Brussels provides cover, funding, and Frontex logistics. Frontline states determine what happens at the water's edge.
Falsifiable prediction (July 31, 2026): Proximity politics will become the operative EU migration doctrine within 18 months of the Ceuta event, without ever being formally declared as such. Specific indicators: Italy's Albania-model external return centres adopted at EU level; Spanish Supreme Court ruling effectively superseded by EU-level legislation or bilateral Morocco agreement; Geneva Convention "safe third country" interpretation broadened to accommodate proximity management; Frontex mandate rewritten to support rather than monitor frontline state enforcement.
The de jure moment will not be announced. It will be identified retrospectively — a treaty amendment, a CJEU ruling, or a Commission regulation that formalises what is already operating on the ground.
The charge: EU migration doctrine is being rewritten by accumulated exception, and nobody intends to announce it.
